Introduction

TouchApp Inc. ("Company", "we", "our", "us") respects the intellectual property rights of others and expects users of the SENSY.TV platform ("Platform") to do the same. This Copyright Policy explains how we address claims of copyright infringement.

Reporting Copyright Infringements

Notification of Infringement


If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our designated Copyright Agent with the following information in writing:
  • - A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
  • - A description of the copyrighted work that you claim has been infringed.
  • - A description of where the material that you claim is infringing is located on the Platform.
  • - Your address, telephone number, and email address.
  • - A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • - A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Removal of Infringing Material

Upon Receipt of Notification


Upon receipt of a valid notification of claimed copyright infringement, we will:
  • - Remove or disable access to the allegedly infringing material.
  • - Notify the user who posted the material that we have removed or disabled access to the material.
  • - Provide the user with a copy of the notification of claimed infringement.

Counter-Notification

Filing a Counter-Notification


If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. The counter-notification must include:
  • - Your physical or electronic signature.
  • - Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
  • - A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • - Your name, address, telephone number, and email address.
  • - A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the Platform may be found, and that you will accept service of process from the person who provided the original notification of the alleged infringement or an agent of such person.

Actions Upon Receipt of Counter-Notification

Upon receipt of a valid counter-notification, we will:
  • - Promptly provide the person who filed the original notification with a copy of the counter-notification.
  • - Inform that person that we will replace the removed material or cease disabling access to it within 10 business days.
  • - Replace the removed material or cease disabling access to it within 10 to 14 business days following receipt of the counter-notification, unless our Copyright Agent receives notice from the person who filed the original notification that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our Platform.

Repeat Infringers

We will terminate user accounts that are subject to repeated valid claims of copyright infringement in appropriate circumstances and at our discretion.

Responsibility for Content

Users and creators are solely responsible for ensuring that the content they post, upload, or otherwise make available on the Platform does not infringe on any third-party intellectual property rights. TouchApp Inc. is not liable for any content posted by users or creators.

Changes to the Copyright Policy

We reserve the right to modify this Copyright Policy at any time. Changes will be effective immediately upon posting the updated policy on our Platform. Users will be notified of significant changes via email or through a notice on our website.
