Introduction

These Creator Terms and Conditions ("Terms") govern the relationship between TouchApp Inc. ("Company", "we", "our", "us") and creators ("Creators") who use the SENSY.TV platform ("Platform") to upload and share content. By becoming a Creator, you agree to comply with these Terms.

Application Process

To apply to become a Creator, you must complete the application form, providing the following information:

Approval

We will review your application within 24-48 hours and notify you of our decision via email. We reserve the right to approve or deny any application at our discretion. Approved Creators must upload a minimum of 5 premium videos to become visible as Creators on the Platform.

Content Guidelines

Acceptable Content

Creators are responsible for ensuring that their content:

Sensitive Content

Creators must mark any content that includes sensitive topics or graphic material as "sensitive." Such content will be displayed with a sensitive content warning and a "See anyway" button to protect users who do not wish to view sensitive material.

Ownership and Rights

Creators retain ownership of their content but grant the Company a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content on the Platform.

Responsibility for Content

Creators are solely responsible for the content they upload, including obtaining necessary permissions and consents from patients featured in their content. Creators must ensure that any advice or information provided to subscribers is accurate and complies with relevant laws and regulations. TouchApp Inc. is not liable for any claims, damages, or legal actions arising from creators' content or communications on the Platform.

Monetization and Payments

Subscription Plans

Creators can set subscription prices for Premium and Mastery content. Premium includes access to all premium posts and chat unlocking, while Mastery includes all premium features plus courses.

Payouts

Creators can request payouts once their earnings reach a minimum of $100. Payouts are processed via Stripe and are subject to a 30% platform fee. Creators must submit payout requests through their profile settings.

Payment Processing

Payouts will be processed within 7-10 business days of the request. Creators will receive notifications about the status of their payout requests.

Termination

Voluntary Termination

Creators may terminate their creator status at any time by contacting us. Upon termination, all content uploaded by the Creator will be removed from the Platform.

Involuntary Termination

We reserve the right to suspend or terminate a Creator's account for violating these Terms, the Platform's Terms of Service, or any applicable laws. In such cases, the Creator will be notified via email.

Limitation of Liability

To the fullest extent permitted by law, TouchApp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Platform. Your continued use of the Platform after the changes become effective constitutes your acceptance of the new Terms.
