End User License Agreement (EULA)
Introduction
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and TouchApp Inc. ("Company", "we", "our", "us") for the use of the SENSY.TV platform ("Platform"). By accessing or using the Platform, you agree to be bound by the terms of this Agreement.
License Grant
Limited License
We grant you a non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with this Agreement.

- - Copy, modify, or create derivative works of the Platform.
- - Distribute, transfer, sublicense, lease, lend, or rent the Platform to any third party.
- - Reverse engineer, decompile, or disassemble the Platform.
- - Use the Platform in any manner that violates any applicable laws or regulations.
Ownership
Intellectual Property
The Platform and all related materials, including but not limited to software, images, text, and trademarks, are the property of TouchApp Inc. and are protected by intellectual property laws. You do not acquire any ownership rights by using the Platform.
User Content
By uploading or posting any content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content on the Platform. You represent and warrant that you have the necessary rights to grant this license.
Responsibility for Content
Users and creators are solely responsible for any content they post, upload, or otherwise make available on the Platform. This includes ensuring they have the necessary rights and permissions to share any third-party content, including images and videos of patients. TouchApp Inc. is not liable for any content posted by users or creators.
Termination
Termination by You
You may terminate this Agreement at any time by ceasing to use the Platform and deleting your account.
Termination by Us
We may terminate this Agreement and your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease.
Limitation of Liability
To the fullest extent permitted by law, TouchApp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- - Your use of or inability to use the Platform
- - Any unauthorized access to or use of our servers and/or any personal information stored therein
- - Any interruption or cessation of transmission to or from the Platform
- - Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party
- - Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Platform
- - Any advice, information, or communication provided by creators to subscribers
Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Changes to the Agreement
We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on the Platform. Your continued use of the Platform after the changes become effective constitutes your acceptance of the new Agreement.
